Privacy policy

Listing Media Creative Agency (“the studio”, “we”) is a real estate photography and film studio based in Green Point, Cape Town, and is the responsible party for the personal information described here. From agents and agencies: names, work email addresses and phone numbers, the agency you work for and your role in it, your portal login and the times you use it, and your communication preferences.

About properties: the address and details of each property we are booked to shoot (bedrooms, access notes, asking price where given), the photographs, film and aerial footage we make there, and the review notes you leave on them. A home can reveal information about the people who live in it; we treat the media as personal information of the occupant where it does.

Business records: bookings, invoices, payments, statements, the signed agreement and the messages we send you.

From the website: what you type into the enquiry and rate card forms, and standard server logs (address, browser, pages requested) kept for security.

We do not collect identity numbers, financial account details of individuals, or information about children.

To confirm and carry out shoots, deliver galleries, review and correct the work, invoice and collect payment, and keep the records the law requires of a business. This is processing necessary to perform our agreement with your agency.

To tell you about bookings, deliveries and invoices by email, and to send occasional notes about our services to agencies we work with. You can stop the latter at any time by replying to any such email or writing to [email protected].

To show examples of our work. A shoot appears in our portfolio only once the property is on the market, only with the agency’s knowledge, and never with an address the agency has asked us not to show.

We do not sell personal information. We share it with the service providers who run our systems, each bound to process it only on our instructions: hosting (Railway), file storage (Cloudflare), email delivery (Zoho), calendar and maps (Google) and our own studio notifications (Telegram, which carries booking details to the photographer only). Where a provider stores data outside South Africa, it does so under contractual protections at least equivalent to POPIA, as section 72 requires.

Galleries are shared with the people you choose to share the link with. Anyone with a share link can view the images; downloads follow the release policy agreed with your agency.

We disclose information to a court, regulator or law enforcement body when the law requires it.

Galleries and their files are kept for the retention period shown in the gallery (twelve months by default) and are then deleted; you are reminded before that happens. Invoices, statements and agreements are kept for five years after the end of the tax year to which they relate, as the tax law requires. Portal accounts and contact details are kept while your agency works with us and removed on request once no open matters remain. Server logs are kept for ninety days.

Access to the studio system is by individual login only; agents see their own shoots and agency administrators see their agency’s. Files are stored in private storage and served through short-lived links. Connections are encrypted. Staff access is limited to the studio. Should a breach affect your information, we will notify you and the Information Regulator as section 22 requires.

The website sets no tracking or advertising cookies. The portal and studio set one cookie to keep you signed in; your theme choice is remembered in your browser. We do not use third-party analytics.

You may ask what personal information we hold about you, ask us to correct or delete it, object to processing for direct marketing, and withdraw consent where processing rests on consent. Write to [email protected] and we respond within a reasonable time, normally within thirty days. Requests for access to records are handled under our PAIA manual.

We update this policy when our practices or the law change and show the date at the top. Material changes are sent to agency administrators by email.
